On or about September 5, 2022 , ESPADAS, acting under color of authority as an officer of CITY OF LOS ANGELES and LOS ANGELES POLICE DEPARTMENT, responded to a call of domestic violence in Mission Hills, California and encountered HALYAK. Substantially motivated by her sex, ESPADAS detained, patted down, searched, handcuffed, deprived personal property of, arrested, transported, placed a Penal Code section 5150 hold upon, subjected to physical restraints and chemical sedation, and/or confined HALYAK against her will and without her consent. On or about September 9, 2022 , which was one day after HALYAK was released from involuntary confinement, and continuing to and through September 25, 2023 , ESPADAS, while engaged or purporting to be engaged in his official duties as an officer of CITY OF LOS ANGELES and LOS ANGELES POLICE DEPARTMENT, using his position of authority, under color of law, with no legitimate law-enforcement purpose, motivated by sex, and through force, threats, intimidation, coercion, and duress, sexually assaulted and engaged in nonconsensual sexual activity with HALYAK, including exchange of lewd messages and images, sexual demands, oral copulation, vaginal penetration, anal penetration, fisting, sex with a third person, and pressuring sex with animals and trans persons.
